This page contains the terms & conditions for shopping at POMME ROUGE. Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.

By placing an order at POMME ROUGE, you warrant that you are at least 18 years old (or have permission from an adult to do so) and accept these terms & conditions which shall apply to all orders placed or to be placed at POMME ROUGE for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

PRICING AND TITLE

We make any effort to ensure that the pricing displayed on our website is correct. However, we reserve the right to alter all the product pricing without notice.

SHIPPING

Every order we receive is subject to availability. We reserve the right to ship products at a later date if the product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of the delivery of the product. 

Orders are processed and shipped within 1-2 business days of purchase unless otherwise noted in the description.  

HANDLING

Once your order has been processed you will receive a tracking number and details via email. The average transit times are as follows (please consider extra time from your customs check):link

We are based in Portugal (Europe), so please note that the customer is responsible for payment of any extra duties, customs, import charges or taxes imposed by the destination country for delivery. No charges or customs will be applied to orders delivered to countries within the European Union.

REFUSED SHIPMENTS

If you choose to refuse your order package, you will be responsible for any duties, taxes and/or customs charges that are incurred on the package, and the cost of returning the package to our Portuguese address. This amount will be deducted from your refund.

COSTUMER COMPLAINTS

We endeavor to respond to all customer complaints or queries within five working days.

FORCE MAJEURE

Events outside POMME ROUGE’s control, which are not reasonably foreseeable, shall be considered force major, meaning that POMME ROUGE is released from POMME ROUGE’s obligations to fulfill contractual agreements. An example of such events is government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

PAYMENT

All products remain POMME ROUGE’s property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents’ permission to buy from POMME ROUGE.

All transfers conducted through POMME ROUGE are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions of the payment gateway chosen for the transaction as they are responsible for the transactions made.

LOCAL TAXES

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customer’s own expense.

RETURNS

All returns and claims must be authorized by POMME ROUGE by email. Your returned items must arrive at our office within 14 days after you receive them. 

FRAUD

POMME ROUGE holds the right to cancel and refund any order(s) that are suspected to be made in a fraudulent or otherwise harmful way in order to secure the safety of our consumers transactions via our online services.

POMME ROUGE reserves the right to seek all remedies available at law and in equity for violations of these Terms & Conditions, including the right to block access to the site and/or forward information on transactions to authorities or payment provider. Individuals violating the restriction of password protected areas of the site may be subject to prosecution.

ADDITIONAL INFORMATION

POMME ROUGE reserves the right to amend any information, including, but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. In the event that a product is sold out, POMME ROUGE has the right to cancel the order and refund any amount paid in the best way. POMME ROUGE shall also notify the customer of equivalent replacement products if available.
